Regarding bans, temporary or permanent ones, i think soulza is right. First of all, if you have bought any premium tank before the forbidden mod list is published, legally they can’t say you knew the rules because there wasn’t any ! Even so, if they really ban an account on this base, they have to, at least, show you some proof of cheating. Their word, legally, is not enough and they have to send you the proof of cheating. In that case, it will be much easy for modders to know how they are detecting mods and i don’t think they want that ! In any case, you can always contest the permaban on legal basis and they have a strong chance to lose cases in court, if it comes to that point. As soulza said, just take one player with enough time and money to sue their ass. We must remember that Wargaming is a commercial company that aim to profits, and they have many millions, not a charity one ! Therefore, they are obliged to comply the laws and they can’t simply do what ever they want ! But guys, the fight will take from us a lot of energy, time and money… remember that before you decide to use or not to use mods.

You might want to read the agreement your accepted when you installed the game (it has also been updated a number of times).  They can ban your account for any reason, and you forfeit all that you have.  They do not have to provide any proof.

I’m sorry dude, but there’s is no company that can made their own laws. No contract is stronger than a country law or EU law. As i said, they can say or write whatever they want, but once you bought anything from them and they accept your money, they are obliged to comply with the law, and, in EU as well as in my country – and i think it’s the same in any EU country – thing are as i said. There is a thing called “unfair contract terms” and those you’re saying are a great example of that, therefore, invalid under EU laws. Take in attention that i’m talking about players that had buy anything from them, not those who play for free. And even those players that play for free have consumer rights. You can google it, there’s tons of online information about that matter. Take a look at this link: http://ec.europa.eu/consumers/consumer_rights/rights-contracts/unfair-contract/index_en.htm
But, also as i said, they will not accept it without a legal fight. It’s up to you to decide if that fight is worth it or if you have conditions of fighting it.

What do you guys make of this. This is the config file for the tidy messenger mod in a well known modders pack. The settings seem odd. I didn’t install any of the mods referenced. Just doing a test install to see what mods he had and this struck me as odd. The web sites listed could be just for updating. These settings are totally different than what you have in your mod Soulza. Not even close.

Read the terms for premiums, you are not buying a perpetual right to a tank, you are obtaining the right of usage that is at Wargaming’s will.  This is a common legal practice in software agreements and has been upheld all over the world.  If you get a perma band, you can elect to have your account reset (forfeit all non premium tanks, credits, stats) and you keep the right to use premium tanks.

Not seeing anyone lining up to spend million to sue.

Yeah that is stupid.  WG is based in Cyprus and has legal professional who do their terms.  They know what is legal in the countries they operate, this is not something written by a kid in his bedroom.  These terms are well vetted and are common.

This is from the EU TOS – You get credit for unused gold and premium time that is all.

    13. Suspension and Closure of Your Account / Termination of these Terms of Service

    Termination for Cause

13.2 If such a termination for cause is prompted by a breach of a contractual obligation under these Terms of Service from our side, you are entitled to (i) a refund for any payments made by you for Gold that at the time of termination has not been used by you in exchange for other Virtual Goods; and (ii) a pro-rata refund of payments for any premium membership active for your Account at the time of termination. Other than that, you will not be entitled to any refunds or compensation.

I Agree. In my clan threw ban a member. He had two days to decide whether to accept the account. the Account had premium tanks, gold, premium days and all crews to 50%. The tanks of missions and lines were deleted. If they do not accept the account after two days permanently deleted

Good morning, it’s nothing safe. Children here work several hours to find that the code of mods sent. The information comes from players who try the mods.

Whatever you put the responsibility is entirely yours.

    ;)
