The problem is that no one is suing them just yet.
That out of the way, second and a little more important thing:
A little birdie told me (lets call this birdie a WOT employee ;)) that they have some means to semi legal inspect what are you doing and what mods are you using. The main problem are owners of premium tanks. They paid for the product, and by banning that players they would be in serious problem for violating the ownership rights.
So, the intern instruction is, and I quote: “…bann only the users that you can pinpoint with 100% certainty and only bann them LIGHTLY. Under no circumstances are you to permanently bann users who have bought premium tanks. Reward premium tanks are excluded (stug IV, toldi III, even Dicker max, FV-4202 (P) and others that are obtained as a reward are excluded) so you can bann users that only have regular and reward tanks. But in any case, double check with your supervisor before banning anyone…”
A couple of things. They can legally read the memory that the game is loaded in, without doing this, the game would not run, and they can check that for mods. Most apps to something similar to ensure you are running a licensed version. They can not take screen shots, or capture the contents of your computer, these are both easy to catch.
As for premium tanks, you do not own them, you get a limited use license for their use, and WG can rescind for violations of the software agreement.
